This website is powered by Shopify, which enables me to provide the online store and related services to you.

By using this website or placing an order, you agree to these Terms of Service, together with any policies referred to in them, including my Privacy Policy and Return and Refund Policy.

If you do not agree to these Terms of Service, you should not use this website or place an order.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, remedy, or protection that cannot lawfully be excluded, restricted, or modified under the Australian Consumer Law or any other applicable consumer protection law.

1. Access and use of this website

You may use this website for lawful personal and non-commercial purposes.

By using this website or placing an order, you confirm that you are at least the age of majority in your state, territory, province, or country of residence, or that you are using this website with the consent of a parent or guardian.

You agree to provide accurate, current, and complete information when placing an order or creating an account, including your email address, billing information, payment information, and shipping details.

You are responsible for maintaining the confidentiality of any account login details and for all activity that occurs through your account.

You must not transfer, sell, assign, or allow another person to use your account without permission.

2. Products, artwork, and product representation

I make reasonable efforts to describe and display products accurately, including colours, materials, scale, finishes, dimensions, and other relevant details.

Please note that colours and product appearance may vary slightly depending on your screen, device settings, lighting conditions, materials, production method, and fulfilment location.

Some prints and canvases are produced on demand after your order is placed. Slight production variations may occur between sizes, formats, surfaces, materials, and fulfilment locations.

Original artworks are one-of-a-kind works and may include natural variations, marks, texture, material characteristics, or other details that form part of the work. I make reasonable efforts to show and describe these details accurately.

Product descriptions, availability, pricing, and images may be updated from time to time. I reserve the right to discontinue products, limit quantities, or change available product options at any time, subject to applicable law.

3. Orders

When you place an order, you are making an offer to purchase the selected product or products.

An order is accepted when I confirm acceptance or begin processing the order. I reserve the right to accept, decline, cancel, or limit an order where there is a valid reason to do so, including suspected fraud, payment issues, product unavailability, pricing errors, address issues, or other operational concerns.

Payment must be received and processed before an order can be accepted or fulfilled.

Please review your order carefully before submitting it. This includes the product, artwork, size, format, quantity, shipping address, billing details, and contact information.

Many prints and canvases are produced on demand after your order is placed. Orders may enter production shortly after they are submitted. Once an order has been sent to production, I may not be able to cancel it, change the artwork, change the product, change the size or format, or update the shipping address.

If you need to request a change or cancellation, please contact me immediately at karina@karinasharpe.com.au. I cannot guarantee that changes or cancellations can be made once an order has been placed.

If I need to cancel, change, or decline an order, I will attempt to contact you using the email address, billing address, shipping address, or phone number provided at checkout.

4. Prices, billing, taxes, and payment

Prices are shown in the currency displayed on the website at the time of purchase.

For Australian customers, prices are shown in Australian dollars and include GST where applicable. Shipping and any optional charges are shown at checkout before you place your order.

For international customers, customs duties, import taxes, VAT, handling fees, brokerage fees, or other charges may apply depending on your location and where the order is produced and shipped from. These charges are your responsibility unless they are clearly collected at checkout.

Prices, discounts, offers, and promotions may change without notice. The price charged for a product will be the price shown at the time your order is placed, subject to correction of errors as set out in these Terms.

Promotions may be subject to separate terms and conditions. If there is a conflict between these Terms and the terms of a specific promotion, the promotion terms will apply to that promotion.

You agree to provide current, complete, and accurate purchase and payment information. You confirm that you are authorised to use the payment method provided and that payment charges incurred by you will be honoured by your payment provider.

5. Shipping and delivery

Delivery times are estimates only and are not guaranteed.

I am not responsible for delays caused by shipping carriers, customs processing, incorrect delivery details, failed delivery attempts, unpaid import charges, natural events, disruptions, or other circumstances outside my reasonable control.

This does not limit any rights you may have under applicable consumer law.

Please check your shipping address carefully before placing your order. I may not be able to replace or refund orders that are delayed, lost, returned, destroyed, or refused because an incorrect address was provided, delivery was refused, or customs duties, import taxes, VAT, handling fees, or other import charges were not paid.

Production and shipping locations may vary depending on the product, fulfilment partner, delivery address, and product availability.

6. Returns, refunds, damaged items, and incorrect items

Please contact me before returning any item. Items returned without prior approval may not be accepted.

For faulty, damaged, or incorrect items, please contact me at karina@karinasharpe.com.au as soon as possible and include your order number, photographs of the item, photographs of the packaging, and a description of the issue.

Nothing in these Terms limits any rights you may have under the Australian Consumer Law or any other applicable consumer protection law.

7. International orders

If you order from outside Australia, you are responsible for ensuring that the product can be lawfully imported into your country.

You are responsible for any customs duties, import taxes, VAT, handling fees, brokerage fees, or other charges applied by your country or by third-party carriers, unless those charges are clearly collected at checkout.

I cannot refund third-party customs duties, import taxes, VAT, handling fees, brokerage fees, or other charges that are not collected by me, except where required by law.

If an international order is refused, returned, delayed, abandoned, or destroyed because customs duties, import taxes, VAT, handling fees, or other import charges were not paid, I may not be able to provide a refund or replacement.

If you are located in the European Union, United Kingdom, or another region with mandatory cancellation or cooling-off rights, those rights apply where required by law. Some products, including made-to-order, custom, personalised, specially produced, digital, or commissioned items, may be excluded from change-of-mind cancellation or return rights where permitted by law.

8. Digital products and commercial client services

Digital products are supplied in accordance with the product description and any specific terms shown at the time of purchase.

Digital products are not eligible for change-of-mind returns or refunds once accessed, downloaded, delivered, or supplied, except where required by law.

These Terms apply to purchases and use of this website. Separate written agreements may apply to commercial imagery, commissioned work, licensing, collaborations, client services, or bespoke projects. If a separate written agreement applies to a project and there is a conflict between that agreement and these Terms, the separate written agreement will apply to that project.

9. Intellectual property

All content on this website, including artworks, photographs, images, graphics, text, product descriptions, designs, logos, trademarks, layout, video, audio, and other materials, is owned by Karina Sharpe, Very Splendid Pty Ltd, or relevant licensors, and is protected by Australian and international copyright, trade mark, and intellectual property laws.

You may view and use this website for personal, non-commercial purposes only.

You must not copy, reproduce, download, store, screenshot for commercial use, distribute, modify, publish, display, transmit, create derivative works from, train artificial intelligence systems on, scrape, extract, license, sell, or otherwise exploit any content from this website without prior written permission.

Purchasing an artwork, print, canvas, digital product, or other item does not transfer copyright, reproduction rights, licensing rights, commercial usage rights, or any other intellectual property rights in the work.

You must not use the Karina Sharpe name, logo, product names, artwork titles, images, photographs, designs, copy, or other brand elements without prior written permission.

All rights not expressly granted are reserved.

10. Reviews, feedback, and submissions

If you submit a review, testimonial, comment, suggestion, idea, message, image, or other feedback through this website, by email, through social media, or through another public channel, you grant me permission to use, reproduce, publish, edit, and display that feedback for purposes connected with operating, improving, and promoting this website, the products, and the Karina Sharpe brand.

You confirm that any feedback or material you submit is accurate, does not infringe the rights of another person, and does not contain unlawful, abusive, misleading, defamatory, obscene, or harmful content.

I may monitor, edit, or remove feedback where I consider it unlawful, misleading, offensive, inappropriate, in breach of these Terms, or otherwise unsuitable.

This section does not apply to confidential materials, commercial client briefs, commissioned imagery, licensing materials, or separate project communications unless permission is expressly given or a separate written agreement allows it.

This website is powered by Shopify, which enables me to provide the online store and related services to you.

If I do not immediately enforce a right under these Terms, that does not mean I waive that right.

These Terms, together with any policies linked or referred to on this website, form the agreement between you and Karina Sharpe / Very Splendid Pty Ltd in relation to your use of this website and purchases made through it.

Any ambiguity in these Terms will not be interpreted against either party solely because one party drafted the wording.

24. Governing law

These Terms are governed by the laws of Queensland, Australia.

You and I submit to the non-exclusive jurisdiction of the courts of Queensland, Australia, and any courts that may hear appeals from those courts.

If you are located outside Australia, you may also have mandatory rights under the laws of your country or region. Nothing in these Terms is intended to limit any mandatory rights that cannot lawfully be excluded.

The version published on this page at the time you use the website or place an order will apply to that use or order, unless otherwise required by law.
