1. About these Terms

This website is operated by Karina Sharpe, a trading entity of Very Splendid Pty Ltd. In these Terms of Service, “I”, “me” and “my” refer to Karina Sharpe / Very Splendid Pty Ltd.

These Terms apply when you visit, browse, purchase from or otherwise use this website.

By using this website or placing an order, you agree to these Terms together with any policies referred to in them, including my Privacy Policy, Shipping Policy and Return and Refund Policy.

This online store currently accepts orders for delivery within Australia only.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law.

Separate written agreements may apply to commercial photography, commissioned work, licensing, collaborations or other client services.

2. Products and artwork

I make reasonable efforts to represent each artwork accurately, including its colour, scale, materials, dimensions and presentation.

Fine Art Prints are produced on Ilford GALERIE Prestige Smooth Pearl 310gsm paper and are available unframed or professionally framed, as described on each product page.

Framed Fine Art Prints are made to order in Sydney in Black, White or Natural Oak, protected with UV-resistant Shinkolite Perspex and supplied ready to hang.

Colours may appear slightly different between screens and the finished print due to device settings, lighting and the nature of printed materials. Frames may also show natural variation in grain and tone.

Some artworks include a white border or other presentation details as part of the artwork design. These will be shown or described on the relevant product page.

Special Edition works may use different materials, processes, framing or presentation methods. Any material differences will be described on the relevant product page.

3. Orders and cancellations

Please review your order carefully before placing it, including the artwork, size, presentation, frame finish and delivery details.

Fine Art Prints and some Special Edition works are made to order. Production may begin soon after an order is placed.

If you need to request a change or cancellation, please contact me as soon as possible at karina@karinasharpe.com.au. Once production has begun, changes or cancellations may no longer be possible.

I may decline or cancel an order where there is a reasonable basis to do so, including payment issues, suspected fraud, product unavailability, a genuine pricing or listing error, or an inability to fulfil the order. If I cancel an order after payment has been received, the relevant payment will be refunded.

This does not affect your rights under the Australian Consumer Law.

4. Prices, payment and promotions

All prices are shown in Australian dollars (AUD) and include GST where applicable.

Standard delivery is free Australia-wide.

Prices, products and promotions may change from time to time. The price applying to your order is the price displayed when the order is placed, subject to correction of a genuine error.

Discount codes and promotional offers may have additional conditions, including expiry dates, minimum spends or limits on use. Where specific promotional conditions are provided, those conditions apply to that promotion.

You must provide accurate and complete payment and order information and be authorised to use the payment method provided.

5. Production, shipping and delivery

Fine Art Prints are made to order in Sydney and delivered within Australia.

Special Edition works may be produced or dispatched separately where stated on the relevant product page.

Production and delivery timeframes are estimates and may be affected by production demand, carrier delays, public holidays, weather or other circumstances outside my reasonable control.

Tracking information will be provided when available.

Please check your delivery address carefully before placing your order. If you notice an error, contact me as soon as possible. Once an order has entered production or been dispatched, I may not be able to change the delivery address.

6. Returns, damage and consumer rights

Returns, refunds, damaged items and incorrect orders are handled in accordance with my Return and Refund Policy.

Because Fine Art Prints and some other works are made to order, I do not generally accept returns or exchanges for change of mind.

If your order arrives faulty, damaged or incorrect, please contact me as soon as possible at karina@karinasharpe.com.au and include your order number, photographs of the item and packaging, and a description of the issue.

Please contact me before returning an item so I can provide appropriate instructions.

Nothing in these Terms or my Return and Refund Policy limits your rights under the Australian Consumer Law.

Goods sold through this store come with consumer guarantees, including guarantees relating to acceptable quality, matching their description and fitness for purpose where applicable.

7. Intellectual property

Unless otherwise stated, all content on this website — including artworks, photographs, images, graphics, text, product descriptions, designs, video, logos and other materials — is owned by Karina Sharpe, Very Splendid Pty Ltd or the relevant rights holder and is protected by applicable intellectual property laws.

You may view this website for personal, non-commercial purposes.

You must not reproduce, publish, distribute, modify, commercially exploit, scrape, extract, licence, sell, create derivative works from, or use website content to train artificial intelligence systems without prior written permission.

Purchasing an artwork or print does not transfer copyright, reproduction rights, licensing rights or commercial usage rights in the artwork.

All rights not expressly granted are reserved.

8. Website use and third-party services

You must not use this website unlawfully, interfere with its security or operation, attempt unauthorised access, or use automated systems to extract or reproduce website content without permission.

This website may use or link to third-party services including payment providers, shipping providers, fulfilment partners and external websites.

Third-party services may be subject to their own terms and privacy policies. I am not responsible for the operation or content of third-party services that are outside my reasonable control.

9. Privacy

Personal information is handled in accordance with my Privacy Policy and applicable Australian privacy law.

Please refer to the Privacy Policy for information about how personal information is collected, used and handled.

10. Errors and availability

I take reasonable care to keep product information, pricing and availability accurate.

Occasionally, information may contain an error or a product may become unavailable after an order is placed.

If an error materially affects your order, I will contact you and, where appropriate, give you the option to proceed with corrected information or receive a refund.

Products, sizes, frame finishes and Special Edition works may be changed or discontinued from time to time.

11. Liability and events outside reasonable control

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability arising under the Australian Consumer Law.

To the extent permitted by law, I am not responsible for loss arising solely from circumstances outside my reasonable control, or from use of a product in a way that is inconsistent with its intended purpose or care instructions.

If an event outside my reasonable control materially affects my ability to fulfill an order, I will take reasonable steps to keep you informed and resolve the order fairly.

12. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

A failure or delay in exercising a right under these Terms does not automatically waive that right.

These Terms, together with the policies and information expressly incorporated into them, form the terms applying to purchases made through this online store unless a separate written agreement applies.

13. Governing law and changes to these Terms

These Terms are governed by the laws of Queensland, Australia.

You and I submit to the non-exclusive jurisdiction of the courts of Queensland and any courts entitled to hear appeals from those courts.

I may update these Terms from time to time.

The Terms in effect when you place an order will apply to that order, unless a change is required by law. Updated Terms apply to future use of the website and future orders.
